Policies

The Student (“Student”) is defined as any person or persons who have requested tutoring for themselves, the Parent/Guardian shall enter into this tutoring agreement on behalf of the Student.

Online Service

All data collected from online services such as customer information, will be solely for the purpose of business means.

EE STRUCTURE

 

 

Mammoth Learning reserves the right to raise rates at any time with advanced notice prior to registration. An email/SMS notification or letter will be deemed sufficient notice. Scheduling and program availability are on a first-come, first-served basis.

TERMS AND CONDITIONS OF PAYMENT

 

 

Tutoring Contract Duration. Student agrees to be enrolled for the duration of the current school term from the time of enrolment until the end of the school term as determined by the Mammoth Learning calendar. Parent/Guardian/Student must pay in full for the full term at the time of enrolment before the term begins.

Tutors. Lessons will be organised by the Principal Teacher (Ms Le). At times, a substitute teacher may be used in the case that the Principal Tutor is unable to teach, top priority will be allocated to a teacher with teaching qualifications, otherwise a trained tutor may be used.

Payment for Services. Payment must be paid in full at the time the Student enrols and will cover all fees for services for the current term of ten weeks.

Late Payment. Classes will only commence for students who have paid their upfront Fee in full. Should there be a late payment, the student will not be able to attend until paid in full. This is to ensure student enrolment is locked in.

Forms of Payment.  Payment may be submitted as Cash or Bank Transfer only. It is the responsibility of the Parent/Guardian to send payments correctly.

Refund Policy.  There will be no refund unless there has been a breach of the Competition and Consumer Act 2010 (Cth).

TERMS AND CONDITIONS FOR CANCELLATIONS

 

 

Cancellations. In order to honour our tutors’ time and to encourage our Students to view their tutoring time seriously, we uphold strict policies regarding cancellations.

  • If Student cannot attend a class, please notify Mammoth Learning at least 24 hours before the class to receive credit and therefore reschedule. Notification in person/email/phone call will be accepted.
  • No credit or rescheduling will be available if notified with less than 24 hours prior to the lesson.
  • Only 2 cancellationscredits are allowed each term. More than 2 cancellations within the same month will deem Student ineligible for any credit or rescheduling.
  • Excessive cancellations may result in the termination of Student’s contract and payment will not be refunded. These credits may not be rolled over to the following terms.
  • If the tutor cannot attend a scheduled session, the Student will either receive advance notice and the session will be rescheduled or the Student may be referred to another teacher.
  • Credit to be defined as a replacement class, at which the time and day will be organised by the teacher.

Late Arrival. There will be no rescheduling allotted for late arrival

NON-SOLICITATION OF TUTORS

Student agrees that he/she will not solicit any tutors or employees of Mammoth Learning to work for his/her own or any other personal or business ventures. Student agrees that during the period of contract and for a period of two (2) years immediately after termination of this agreement with Mammoth Learning, Student will not, either directly or indirectly for himself/herself or for any other person, family or business, call upon, solicit, divert, or take away, or attempt to solicit, divert or take away any of the tutors, business, or partners of Mammoth Learning with whom Student has become acquainted during or after Student’s contract with Mammoth Learning.

OWNERSHIP & USE OF INFORMATION

Student agrees that all papers, course materials, workbooks, or other data and any and all copies thereof relating to Mammoth Learning’s courses or business, some of which may be prepared by the tutor, and all objects associated therewith Mammoth Learning shall be Mammoth Learning’s property. Student shall not, except for Mammoth Learning use, copy or duplicate any of the above-mentioned documents or objects.

STUDENT SUPERVISION

No additional supervision will be provided outside of tutoring services and hours.

STUDENT PICK-UP

Students must be picked up promptly after their tutoring session. It will not be the responsibility of the Tutor to supervise outside of serviced hours.

RIGHT TO REFUSE SERVICE

Mammoth Learning reserves the right to refuse service and terminate existing tutoring agreements with no refund to any Student who is uncooperative or misbehaves excessively. It is within the best interest of every other student and parent that we maintain a positive learning environment by ensuring each student obtains equal learning opportunities.

CELL PHONE POLICY

Students are not permitted to use their phones during their tutoring session as it may prove to be a distraction. Phones may be confiscated and returned to the Student at the end of the lesson.

INSURANCE

Student acknowledges that Mammoth Learning does not carry any insurance with respect to the school’s premises besides general liability and Professional Indemnity insurance and hereby holds Mammoth Learning harmless against any and all losses at the premises.

DISCHARGE OF LIABILITY

Student agrees to release and discharge Mammoth Learning from any liability, causes of action, claims or damages for personal injury and property damage.

Mammoth Learning is not responsible for supervision outside of designated tutoring session times.

NO WARRANTIES

Mammoth Learning makes no promises or warranties with regards to a Student’s performance.

CHANGES IN POLICY

Mammoth Learning reserves the right to change our policies at any time at our sole discretion without notice. The most updated policies will be posted on our website and will be effective immediately upon posting. Parent/Guardian acknowledges and agrees that it is his/her responsibility to review these policies from time to time and be familiarised with its terms and conditions.

Students

On behalf of the student, the Parent/Guardian shall enter into this tutoring agreement and shall accept and agree to all the terms and conditions of the policies contained herein on behalf of the Student.

REFERRAL PROGRAM

Customers are entitled to the incentivised amount as advertised given that the referred applicant has paid for the full term of 10 weeks/10 lessons upfront. Referral amount will be refunded to the referrer as store credit, i.e can be used to subsidise future term payments.
